1. Acceptance of Terms By clicking on the “SIGNUP” option, you (“Participant,” “You,” or “Your”) agree to the terms, conditions, obligations, representations, warranties, and agreements outlined in this document (“Agreement”). If you do not accept this Agreement, you are not authorized to access or use any content, information, courseware, products, or services (“Services”) provided on https://www.gcqstudyabroad.com (“Website”), owned and operated by GCQ Solutions Pvt. Ltd. (“GCQ Study Abroad,” “Us,” “We,” or “Our”).

2. User ID and Password You acknowledge that your user ID and password (“Participant Account”) are for your exclusive use only. Sharing your credentials with others is strictly prohibited and may result in immediate termination of access. You are responsible for maintaining the confidentiality of your credentials and must notify our Help and Support Team immediately if unauthorized access occurs. GCQ Study Abroad shall not be liable for any misuse of your Participant Account.

3. Content and Courseware As part of our Services, we grant you access to content, courseware, practice tests, and other materials related to the certification training course you have registered for (“Content and Courseware”). We reserve the right to amend, revise, or update the Content and Courseware at our discretion. Additional fees may apply for access to updated materials.

4. Usage of the Website and Services We grant you a personal, restricted, non-transferable, non-exclusive, and revocable license to use the Website, Services, and Content and Courseware for your personal, non-commercial use until the completion of your enrolled course or termination of this Agreement. You are not permitted to reproduce, transmit, distribute, sub-license, or create derivative works without our prior written consent.

5. Intellectual Property Rights All intellectual property rights related to the Website, Services, and Content and Courseware remain the exclusive property of GCQ Solutions Pvt. Ltd. Your use of the Website does not grant you any ownership rights or interests in our intellectual property.

6. Usage of Personal Information By using our Services, you consent to the use of your personal information, including photographs and videos, for promotional purposes. However, we do not share your personal information with third-party marketing databases or disclose it to unauthorized third parties except as required by law.

7. Limitation of Liability Your use of the Website, Services, and Content and Courseware is at your sole risk. We do not guarantee uninterrupted access or accuracy of information. GCQ Study Abroad shall not be liable for direct, indirect, incidental, or consequential damages resulting from the use or inability to use our Services. Our liability shall not exceed the fees paid by you for the specific course.

8. Term and Termination This Agreement becomes effective upon your acceptance and remains valid until you maintain a fully paid-up Participant Account or until terminated by us. We reserve the right to terminate this Agreement and block access immediately in case of misconduct, misrepresentation, or breach of obligations.

9. Indemnity You agree to indemnify and hold GCQ Study Abroad, its directors, employees, and agents harmless against any claims, losses, or liabilities arising from unauthorized use of the Website or breach of this Agreement.

10. Waiver Failure to enforce any rights under this Agreement does not constitute a waiver. Any waiver must be in writing and signed by an authorized representative.

11. Severability If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mysore, India. In the event of a merger, acquisition, or sale of assets, your personal data may be transferred with prior notice.

13. Payment & Refund Policy

• 1. Full payment must be made before accessing any study materials or services.
  2. All payments are non-refundable. However, if GCQ Study Abroad fails to deliver the committed services, only the commitment fee will be refunded.
  3. As a token of appreciation for your success, GCQ Study Abroad will refund the commitment fee once you reach your university campus. This gesture is meant to celebrate your achievement and support your journey ahead.
     Please note: This post-arrival refund is not applicable to students admitted to German public universities. For more details, refer to our Refund Policy.
  4. If services are suspended or terminated due to non-compliance with the terms of this Agreement, any payments made will be forfeited.
  5. Any disputes arising from this Agreement shall fall under the exclusive jurisdiction of the courts in Mysore, Karnataka.

14. Amendments and Assignment We reserve the right to amend this Agreement at any time without prior notice. The revised Agreement will be posted on the Website, and continued use of our Services implies acceptance. You may not assign this Agreement to any third party.

15. Entire Agreement This Agreement, along with our Privacy Policy, Refund Policy, Rescheduling Policy, and Terms of Use, constitutes the entire agreement governing your use of our Website. By submitting our web form, you agree to receive promotional calls and SMS from third-party platforms.
